Personal Data We Process

Depending on how you interact with us, we may process the following categories of personal data:

  • Contact & account data — name, email address, postal address, phone number, and login credentials where you create an account.
  • Order & transaction data — products purchased, order history, billing details and payment status. Payment card details are processed directly by our payment providers and are not stored by us.
  • Content you submit — files, audio recordings, artwork, artist names, release titles, metadata and other materials you provide to us for distribution or promotion. Some of this content is intended for public release (see section 4b).
  • Communication data — the content of emails, form submissions and booking requests you send us.
  • Technical & usage data — IP address, device and browser information, and log data automatically generated when you visit the website.

Purposes & Legal Bases

We process personal data to perform our contracts with you (providing distribution, promotion and subscription services and handling orders), to comply with legal obligations (such as accounting and tax requirements), and on the basis of our legitimate interests in operating, securing and improving our website and services. Where the law requires it — for example for marketing emails or non-essential cookies — we rely on your consent, which you may withdraw at any time.

Our website uses cookies and similar technologies that are necessary for the site and store to function, as well as optional technologies that help us understand how the site is used. Each of these providers processes data under its own privacy policy, which applies in addition to this one. We share data with them only to the extent necessary to provide our services.

In addition, Berger Publishing GmbH — an affiliated company — has access to certain personal data where this is necessary for the joint administration and operation of our services.

We may also disclose personal data where required by law or to protect our legitimate interests, for example in connection with legal claims.

Publication of Content You Submit

Our core service is the distribution and promotion of music. When you submit materials to us — such as recordings, artwork, artist names, release titles and related metadata — you understand and agree that this content is intended for public release. We make it available to third-party streaming platforms, stores and distribution partners (for example Kontor New Media), where it is published and displayed to the public as part of your release.

This means certain information you provide, including artist and release names and associated artwork, will become publicly accessible by design. Please only submit content you have the right to share and publish.

Data Transfers Abroad

Some of our service providers are based outside Switzerland and the EEA, including in the United States. Where personal data is transferred to a country without an adequate level of data protection, we ensure appropriate safeguards are in place, such as the European Commission's Standard Contractual Clauses or equivalent measures recognised under Swiss law.

Retention

We retain personal data only for as long as necessary for the purposes set out in this policy, or as required by applicable legal retention obligations (for example, accounting records must generally be kept for ten years under Swiss law). When data is no longer required, we delete or anonymise it.

If you have consented to receive marketing emails from us, you may unsubscribe at any time using the link in any marketing email or by contacting us. Unsubscribing from marketing does not affect transactional messages relating to your orders or subscriptions.
